User Responsibilities

Domain Ownership Policy

If your domain is purchased through Help Me LLC, please be aware that we retain ownership of the domain. Should you wish to take ownership of the domain, there will be a one-time fee of $300 to cover our time, effort, and ongoing costs associated with maintaining the domain each year.

Limitations of Liability

Our site may contain links to third-party websites or services that are not owned or controlled by Help Me LLC. Help Me LLC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Help Me LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Termination of Use

Help Me LLC reserves the right to terminate or suspend your access to our website and its services at any time, without prior notice, for any reason whatsoever, including without limitation if you breach the Terms & Conditions. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

You agree that use of our website is at your sole risk. Our website is provided on an "as is" and "as available" basis. Help Me LLC expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the state of Kentucky where Help Me LLC is registered, without regard to its conflict of law provisions. These Terms shall be governed and construed in accordance with the laws of United States without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our site supersede and replace any prior agreements we might have between us.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the site.

Membership Billing and Cancellation Policy

Memberships bill automatically on the schedule you selected at purchase (monthly, quarterly, or yearly), on the same calendar day each period, until you cancel. Example: if you sign up on March 10, you'll be billed again on April 10, May 10, and so on.

You may cancel your membership at any time. To cancel, submit the Cancellation form at least 48 hours before your next payment date. If your request is submitted less than 48 hours before your payment date, the payment may still be processed, and no refund will be issued for that transaction.

There are no partial or prorated refunds on any billing plan. Cancelling stops future charges but does not refund the current billing period, and your access continues until your cancellation is processed. Questions about your membership or a charge? Billing Questions and Payment Disputes

If you believe you've been billed in error or have any question about a charge, you agree to contact us first at [email protected] and give us a reasonable opportunity to resolve the issue before disputing the charge with your bank or card issuer. Most billing questions are resolved within one business day. You acknowledge that charges processed before a valid, timely cancellation (submitted via the Cancellation form at least 48 hours before the billing date) are valid charges; that we maintain records of enrollment, agreement to these Terms, billing history, cancellation submissions, and member logins, and may submit these records as evidence in any payment dispute; and that filing a chargeback on a valid charge without contacting us first may result in immediate termination of your membership.

In-Person Training Cancellation Policy

If you register and pay for one of our in-person training classes and later decide to cancel your attendance, you have two options:

Transfer – You may request to be moved to a different upcoming training session at no additional charge, subject to availability.

Refund – If you prefer to cancel entirely, we will issue a refund of the amount paid, less a 25% processing fee. This fee covers administrative costs, materials, and non-refundable expenses incurred on our end.

To request a transfer or refund, please contact us at least 7 days before the scheduled training. No-shows or cancellations made within 7 days of the event may not be eligible for a refund or transfer.

Membership and Contract Termination Policy

If a customer wishes to end their membership or contract with us but would like to retain ownership of their website and/or phone number, a transfer fee of $500 will apply. This fee covers the administrative costs associated with transferring these assets. Please contact our support team to initiate the process.

Christmas Lights Website — Website Development Terms

1. Agreement Overview

When you purchase the Christmas Lights Website Package from Help Me LLC, you are entering into a 24-month service agreement. You may pay in one of two ways:

Monthly: $199 per month for 24 months.

Paid upfront: $2,000 as a single payment covering the same 24-month term.

Both options include the same website build, the same hosting, and the same support, and both are governed by identical terms. Paying upfront is a prepayment discount and does not shorten, extend, or otherwise change the 24-month term.

Upfront payment is non-refundable and is not prorated if you cancel before the 24-month term ends.

Template websites included in basic memberships do not fall under this agreement.

2. What This Package Is

The Christmas Lights Website is a custom, multi-page website built specifically for your business, including original page copy, service area pages, and search-focused page structure completed during the build. This package does not include ongoing search engine optimization services, monthly blog writing, content marketing, paid advertising management, or social media management. Search optimization work is performed once, during the build. Any ongoing marketing services are separate and are not part of this agreement.

The 24-month minimum term reflects the cost of a fully custom build combined with hosting, security, and technical support for the duration of the term.

3. After the Initial 24-Month Term

At the end of the 24-month term, your service automatically converts to a month-to-month covering continued hosting, security, backups, and technical support. You may cancel at any time with 48 hours' written notice. This applies equally to clients who paid monthly and clients who paid upfront.

4. Early Cancellation

By enrolling, you agree to maintain active payments for the full 24-month term.

If you cancel before completing the 24-month term, all website services, hosting, automations, and associated features will be disabled.

5. Re-Enrollment After Early Cancellation

If you cancel early and later wish to return to the Christmas Lights Website program, you must pay 12 months upfront $2388 at re-enrollment. This covers the substantial upfront work already performed, including custom design, page structure, and content creation.

6. Project Responsibilities and Timeline

You agree to provide all requested content, assets, and business information in the formats and timeframes specified. Timely communication is essential to keep your project on schedule. Standard development time is approximately 4 to 6 weeks from the date we receive your completed onboarding form and all required materials. This timeline may vary depending on content delivery, revision requests, or scope adjustments.

Clients are asked to respond to emails and revision requests within one business day to avoid project delays.

7. Client Requirements

Before project development begins, you must complete the onboarding form and submit all requested images, videos, and business information. Please submit media assets all at once when possible. Work does not begin until all required materials are received.

8. Photography and Imagery

We strongly prefer to use photographs of your own completed work, and encourage you to submit photos of your installations with your onboarding materials.

If you do not have photographs of your own work available at the time of the build, we will launch your website using licensed stock imagery.

9. Domain Names

If you do not already own a domain name, we will register one on your behalf as part of your website package. Domains registered by Help Me LLC on your behalf remain registered under and owned by Help Me LLC for the duration of your service.

10. Termination and Asset Transfer

If you wish to end your agreement or month-to-month plan and retain ownership of your website and/or phone number, a transfer fee of $500 applies, covering the administrative costs associated with transferring these assets. Contact our support team to begin the process.

11. Technical Support and Communication

Complimentary technical support is included for maintaining your website's functionality, with most issues addressed within two business days of notification.

All project communication is conducted via email. We do not manage project tasks through phone calls, text messages, social media, or other platforms.

An initial and concluding Zoom call may be scheduled at project start and completion for final review.

12. Analytics and Search Console

We will configure Google Analytics and Google Search Console for your website at launch. You are responsible for maintaining access to any Google accounts associated with your business.

13. Site Access

Where dashboard access is provided, you may also grant access to third parties. However, Help Me LLC is not responsible for issues caused by edits or changes made by anyone outside our team. If such changes result in website malfunctions, repair fees may apply.

14. Website Launch

Our priority is to get your website online as quickly as possible once the build is complete and approved.

15. Liability

While we strive for accuracy and dependable performance, Help Me LLC cannot guarantee an error-free website. We are not liable for direct or indirect damages, including lost profits. Your liability to us is limited to the fees outlined in this agreement.

16. Portfolio Rights

Help Me LLC retains the right to display your completed website, or portions of it, within our portfolio, trainings, demonstrations, and marketing materials.

17. Client Acknowledgment

You understand that a website alone does not guarantee leads, traffic, or revenue. A website is the foundation of your online presence. Getting found in your market also depends on factors outside this agreement, including your Google Business Profile, customer reviews, paid advertising, content publishing, and local outreach. These activities are not included in this package and are not services we are obligated to provide under this agreement.

18. Legal Policies

Help Me LLC is not responsible for preparing your website's Privacy Policy, Terms and Conditions, or compliance with state or federal privacy laws, including text messaging consent requirements. We will publish policies you provide but do not provide legal guidance.

19. Service Refusal Rights

While rare, Help Me LLC reserves the right to terminate a project or payment plan at our discretion.

20. Governing Law

This agreement is governed by the laws of the Commonwealth of Kentucky.
